Please read these Terms and Conditions carefully before booking. By completing a booking with Easy Cozy Wellness, whether online, by telephone, or in person, you confirm that you have read, understood, and agreed to be bound by these Terms and Conditions in their entirety. If you do not agree, please do not proceed with your booking.

1About Easy Cozy Wellness

Easy Cozy Wellness ("Easy Cozy," "we," "us," or "our") is a massage therapy and acupressure wellness clinic located at 6418 Dover Rd, North Nanaimo, British Columbia, V9V 1A7. We can be reached by telephone at 1-778-561-0208 or by email at admin@easycozy.ca.

Our practitioners hold membership with the Natural Health Practitioners of Canada (NHPC). Easy Cozy Wellness is not an RMT (Registered Massage Therapist) clinic as defined under the Health Professions Act of British Columbia. Our practitioners are therefore not authorized to provide direct billing to extended health insurance providers or ICBC, and our services are not recognized as insured health services under BC's Medical Services Plan.

Credential Clarification

NHPC membership confirms professional training and adherence to a code of ethics in natural health practice. It does not constitute RMT registration under BC health regulations. Clients seeking insurance-eligible massage therapy should confirm coverage requirements with their insurer before booking.

2Scope of Services

Easy Cozy Wellness provides acupressure, deep tissue massage, reflexology, foot massage, and related manual therapy services for the purpose of pain relief, stress reduction, and general wellness. The services offered at Easy Cozy Wellness are:

Non-diagnostic. We do not diagnose medical conditions.
Non-prescriptive. We do not prescribe medication or treatment plans in place of medical care.
Complementary in nature. Our services are intended to complement, not replace, professional medical treatment.
Subject to change. The specific techniques, session structures, and service offerings on our website reflect current availability and may change without notice.

Services are provided only by the practitioners on duty at the time of your appointment. Easy Cozy Wellness does not guarantee the availability of a specific practitioner.

3Booking and Confirmation

Bookings may be made online via easycozy.ca/booking, by telephone, or in person at our location. A booking is confirmed only when you receive a confirmation notification from our booking system. Provisional bookings not confirmed within the system are not guaranteed.

3.1 No Upfront Payment Required

Payment is not required at the time of booking. Full payment for the session is due at the time of your appointment, prior to or immediately following the session at the discretion of the practitioner.

3.2 Accurate Information

You are responsible for providing accurate contact information, health information, and booking details. Easy Cozy Wellness accepts no responsibility for missed appointments or adverse outcomes resulting from inaccurate information provided at the time of booking or intake.

3.3 Intake Form

First-time clients are required to complete an Easy Cozy Wellness Intake Form prior to their first session. The information provided on the Intake Form forms part of the agreement between the client and Easy Cozy Wellness and is subject to these Terms and Conditions. Returning clients are responsible for notifying Easy Cozy Wellness of any changes to their health information since their last visit.

4Cancellation Policy

4.1 Standard Cancellation

We require a minimum of 4 hours' notice to cancel or reschedule a booked appointment. If you cancel with less than 4 hours' notice, Easy Cozy Wellness may ask you to prepay for future sessions or may decline future bookings.

4.2 No-Show Policy

Clients who do not attend a booked appointment without providing any notice ("no-show") may be required to prepay for future sessions or may be declined future bookings at Easy Cozy Wellness's sole discretion.

4.3 Repeated Cancellations

Repeated late cancellations or no-shows may result in the suspension of online booking privileges. Easy Cozy Wellness reserves the right to decline future bookings from clients with a pattern of late cancellation or non-attendance.

4.4 Easy Cozy Wellness Cancellations

Easy Cozy Wellness reserves the right to cancel or reschedule any appointment due to practitioner illness, emergency, or circumstances beyond our reasonable control. In such cases, we will notify you as promptly as possible and offer to reschedule at your convenience. No cancellation fee will be applied to the client in these circumstances.

5Late Arrival Policy

Clients who arrive late for their appointment will receive the remaining time of their booked session at the full booked rate. Easy Cozy Wellness cannot extend a session beyond its booked end time where doing so would affect subsequent appointments.

We recommend arriving 5 to 10 minutes before your scheduled appointment time, particularly for first visits requiring Intake Form completion.

6Health Disclosure Obligation

You are required to disclose all relevant health information to Easy Cozy Wellness prior to and during your session. This obligation includes but is not limited to:

Current or recent medical conditions, diagnoses, or surgeries
Medications, supplements, or treatments currently being received
Pregnancy or suspected pregnancy
Known allergies or sensitivities to products, oils, or physical pressure
Any areas of the body that should not be touched or that cause pain when touched
Skin conditions, open wounds, bruising, or inflammation
Any condition for which you have been advised to avoid massage by a healthcare provider

Undisclosed conditions: Easy Cozy Wellness and its practitioners accept no liability for adverse outcomes, injury, or aggravation of an undisclosed or misrepresented condition. The liability release in Section 9 of these Terms and Conditions applies with full force where a client has failed to disclose a relevant condition prior to or during their session.

You are responsible for updating your health information at each visit. Easy Cozy Wellness practitioners will ask a brief check-in question at the start of each session; it is your responsibility to answer honestly and completely.

7Contraindications

Certain health conditions are contraindications to massage therapy, meaning that massage may be harmful or is not appropriate. You are responsible for disclosing conditions that may be contraindications. The following is a non-exhaustive list of conditions that require physician clearance before receiving massage therapy at Easy Cozy Wellness:

Active blood clots or deep vein thrombosis (DVT)
Active cancer or areas of the body with confirmed tumour presence, without oncologist clearance
Active skin infections, open wounds, or contagious skin conditions
Cellulitis or acute inflammation in the treatment area
Severe or uncontrolled cardiovascular conditions including recent heart attack or stroke
Significant kidney or liver dysfunction
Uncontrolled or severe high blood pressure
Acute fractures or dislocations
Recent surgery in the area to be treated, without physician clearance
Fever or acute systemic illness
Severe osteoporosis where pressure may cause injury
Any condition for which your physician has specifically advised against massage

Presenting with an undisclosed contraindication is a breach of these Terms and Conditions. Easy Cozy Wellness reserves the right to terminate a session immediately, without refund, if a contraindication is discovered during treatment that was not disclosed prior to the session.

8Pregnancy

Clients who are pregnant or who suspect they may be pregnant must disclose this information before booking or at intake. Certain massage techniques are contraindicated during pregnancy, particularly during the first trimester.

Easy Cozy Wellness will advise on appropriateness of service based on the information provided. We reserve the right to decline services or modify techniques at our discretion to ensure the safety of the client and the unborn child. Clients who do not disclose pregnancy and receive massage as a result assume full responsibility for any associated risks.

9Liability Release

By booking and attending a session at Easy Cozy Wellness, you acknowledge and agree to the following:

9.1 Inherent Risks

Massage therapy involves inherent risks including but not limited to:

Temporary muscle soreness lasting 24 to 72 hours following treatment
Superficial bruising, particularly in areas of deep tissue work
Aggravation of pre-existing, undiscovered, or undisclosed conditions or injuries
Temporary fatigue, lightheadedness, or emotional release following treatment
Skin irritation where massage oils or lotions are applied

You accept these risks as inherent to the services provided and understand that not all outcomes can be predicted or controlled by the practitioner.

9.2 Release of Liability

To the fullest extent permitted by the laws of British Columbia, you release Easy Cozy Wellness, its owners, directors, employees, contractors, and NHPC-member practitioners from any and all claims, damages, losses, costs, or liabilities arising out of or relating to:

Any injury, soreness, or adverse reaction resulting from a session at Easy Cozy Wellness
Any aggravation of a pre-existing condition that was disclosed or could reasonably have been disclosed
Any adverse outcome resulting from information you failed to disclose at intake or during your session
Any outcome arising from your non-compliance with practitioner instructions during the session

9.3 Responsibility Allocation

10Limitation of Liability

To the maximum extent permitted by law, Easy Cozy Wellness's total liability to you for any claim arising out of or related to services provided shall not exceed the amount paid by you for the specific session giving rise to the claim.

Easy Cozy Wellness is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of income, loss of opportunity, or emotional distress, arising out of or related to your use of our services.

Nothing in these Terms and Conditions excludes or limits liability for fraud, personal injury caused by our negligence, or any other liability that cannot be excluded or limited under applicable British Columbia law.

11Right to Refuse or Terminate Service

11.1 Our Right

Easy Cozy Wellness and its practitioners reserve the right to refuse, modify, or terminate any session at any time, without refund, in the following circumstances:

A client discloses or displays a contraindication to massage during intake or mid-session
A client is intoxicated or under the influence of substances that impair their ability to give informed consent or communicate safely
A client behaves in a manner that is abusive, threatening, sexually inappropriate, or otherwise in breach of our professional conduct expectations
The practitioner reasonably determines that continuing the session poses a risk to the client's health or safety

In cases of sexual harassment or threatening behaviour, Easy Cozy Wellness reserves the right to decline all future bookings from the individual concerned and to report the incident to the appropriate authorities.

11.2 Your Right

You have the right to stop or modify your session at any time. You are encouraged to communicate discomfort, changes in preference, or any concern to your practitioner immediately. No penalty will apply to a client who requests a session modification or early termination for health or comfort reasons.

12Professional Conduct Standards

Easy Cozy Wellness operates in accordance with the NHPC Code of Ethics and professional conduct standards. All sessions are strictly therapeutic in nature. No sexual services of any kind are offered, implied, or available at Easy Cozy Wellness. Any client who requests, solicits, or implies interest in sexual services will have their session terminated immediately without refund and will be permanently declined future service.

Draping protocols are maintained throughout every session. You have the right to specify any areas you do not wish to have massaged, and these preferences will be respected without question.

13No Guarantee of Results

Easy Cozy Wellness does not guarantee specific outcomes from any massage therapy session or series of sessions. Individual responses to massage therapy vary based on health history, condition severity, lifestyle factors, and other variables beyond our control.

Our practitioners will provide honest assessments of expected outcomes based on your presentation, but these assessments are professional opinions, not contractual guarantees. The absence of the desired outcome does not constitute grounds for a refund unless the service was not delivered as booked.

14Payments and Pricing

14.1 Current Pricing

Pricing is as published on easycozy.ca at the time of booking. Easy Cozy Wellness reserves the right to update pricing with reasonable notice. Confirmed bookings will be honoured at the price in effect at the time of confirmation unless a significant error has occurred.

14.2 Accepted Payment

Payment is due at the time of each session. Accepted payment methods are displayed at our location and on our booking platform. Easy Cozy Wellness does not offer direct insurance billing. Clients wishing to submit receipts to their insurer are responsible for confirming eligibility with their insurance provider.

14.3 Gift Certificates

Gift certificates purchased from Easy Cozy Wellness are non-refundable and non-transferable for cash value. They may be transferred to another individual for use at Easy Cozy Wellness. Gift certificates are valid for 12 months from the date of purchase unless stated otherwise. Easy Cozy Wellness is not responsible for lost or stolen gift certificates.

14.4 Refunds

Refunds for completed sessions will not be issued on the basis of outcome dissatisfaction alone. If a session was not delivered as booked due to circumstances within our control, we will offer a complimentary partial or full session at our discretion. Disputes regarding charges should be raised with Easy Cozy Wellness directly within 14 days of the session date.

15Privacy and Client Records

Easy Cozy Wellness collects and retains client information, including personal information and the health information you choose to share with us, so that we can provide your sessions safely. This information is handled in accordance with British Columbia's Personal Information Protection Act (PIPA).

15.1 What We Collect

Personal information: name, contact details, date of birth, emergency contact
Health information: medical history, medications, conditions, pregnancy status
Booking data: appointment history, cancellation history, payment records

15.2 How We Use It

Client information is used solely for the purpose of providing massage therapy services and communicating with you about your appointments. We do not sell, share, or disclose client information to third parties except as required by law or with your explicit written consent.

15.3 Retention

Booking, payment and gift card records are kept for 6 years after the end of the tax year they relate to, as the Canada Revenue Agency requires. Other client information is kept only as long as we need it to serve you, then deleted securely. See our Privacy Policy for details. You may request access to your records or request correction of inaccurate information by contacting admin@easycozy.ca.

16Photography and Marketing

Easy Cozy Wellness will not photograph, video record, or use any image of a client in any marketing material, social media, or public communication without explicit written consent obtained separately from these Terms and Conditions.

By booking, you do not grant Easy Cozy Wellness any rights to use your likeness for marketing purposes. Any marketing consent will be requested separately and can be withdrawn at any time.

17Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. Any dispute arising out of or in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of British Columbia.

Where any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

18Disputes and Complaints

18.1 Internal Resolution

We encourage clients to raise any concern or complaint directly with Easy Cozy Wellness before pursuing external channels. Most concerns can be resolved promptly and respectfully. Please contact us at admin@easycozy.ca or 1-778-561-0208 within 14 days of the relevant appointment.

18.2 NHPC Complaints Process

If a complaint relates to practitioner conduct, professionalism, or ethics, clients may also contact the Natural Health Practitioners of Canada (NHPC) through their formal complaints process at nhpcanada.org.

18.3 No Waiver

Failure by Easy Cozy Wellness to enforce any provision of these Terms and Conditions at any time does not constitute a waiver of that provision or of the right to enforce it in the future.

19Amendments to These Terms

Easy Cozy Wellness reserves the right to update or amend these Terms and Conditions at any time. The current version will always be published at easycozy.ca/terms-and-conditions with the effective date noted at the top of the document.

Continued use of Easy Cozy Wellness services following an update to these Terms and Conditions constitutes acceptance of the revised terms. We encourage clients to review this page periodically. Material changes will be communicated via email to clients with active bookings where reasonably practical.

20Acceptance of These Terms

Your Agreement

By completing a booking with Easy Cozy Wellness, whether online, by telephone, or in person, you confirm that you are 18 years of age or older (or are the legal guardian of a minor receiving services); that you have read and understood these Terms and Conditions in full; that you agree to be legally bound by them; and that the health information you have provided or will provide is accurate and complete to the best of your knowledge.
